Terms & Conditions

These Terms of Service (“the Terms”) are a legal agreement between you and MC Yoga (“us” or “we”) (“the Agreement”) regarding your use of services available at http://www.mcyoga.ie/including any downloadable software program that you are accessing or installing on your device or personal computer and the services available through that software program (“the Service”).

 

By using any portion of the Service, you are agreeing to be bound by and are becoming a party to these terms. If you do not agree to be bound by these terms, do not use the Service. If you are using the Service on behalf of your employer, you represent that you are authorised to accept the Terms on your employer’s behalf.

I hereby agree to the following:

​

  1. Even with clear instruction there is the possibility of injury and that it is my responsibility to consult a physician regarding any and all matters involving my personal health and including without limitation: (a) any prior or existing injuries; and (b) my ability to participate in the programs offered by MC Yoga.
    ​

  2. Before taking any exercise please consult your caregiver.  During the class make sure to listen to your body.  You must inform Michelle of any injuries or anything that may affect your class.  Michelle is always happy to discuss how you may be able to modify the yoga poses to make sure you are more comfortable.
     

  3. Please do not practice in your socks and a yoga mat is mandatory.
     

  4. I am participating in yoga classes that require physical exertion, which may be strenuous and may cause physical injury.  I am aware of the risks and hazards involved.  I understand that it is my responsibility to consult with a physician/caregiver prior to and regarding my participation in any physical fitness program, including yoga and Pilates in a studio, live on zoom or a pre-recorded video.  I represent and warrant that I have no medical condition that would prevent my participation in physical fitness activities.  I also understand it is my responsibility to notify Michelle of any new injuries that may arise during the course of my classes.  
     

  5. In consideration of being permitted to participate in the yoga classes in person, on zoom or as a pre-recorded video class, I agree to assume full responsibility for any risks, injuries or damages, known and unknown, which might incur as a result of participating in the program taught to me. In further consideration of being permitted to participate in these classes, I knowingly, voluntarily and expressly waive any claim I may have against the instructor Michelle Cantwell, owner of MC Yoga.  By booking the class, paid or non-paid I accept liability in full.
     

  6. I attest that I have no psychological, medical or emotional condition that would prevent me from safe participation in a yoga class.
     

  7. I release and discharge MC Yoga, its associated and affiliated companies and/or businesses and their respective directors, employees and instructors from all liability, claims, demands or actions that I may take resulting from injury, death, or damages arising from my participation in the physical activity classes (e.g. yoga, Pilates) offered by MC Yoga.
     

  8. I recognise that this Agreement of release and waiver of liability is a legal contract and that I have complete knowledge of its contents.
     

  9. I represent and warrant that any profile information I submit is true and accurate and that I am 18 years of age or older and am capable and competent to enter into, and abide by these Terms.
     

  10. I have read these Terms in their entirety and fully understand the contents and meaning, and by signing up for a subscription to participate in online classes, I understand this means I am signing it of my free will.

 

Program Viewing and Transaction Options

 

On the purchase of an online class(es) with a recording(s) included you view the recording(s) offered an unlimited number of times during your subscription period. MC Yoga may upload or remove programs from the website at any time.

You are responsible for obtaining internet access and a compatible, internet-connected device to stream and/or download programs via websites and applications. The quality of your viewing experience depends on a number of factors, including your viewing device and the quality of your internet connection.

Payments

​

To make a purchase, you must provide a valid payment method.

​

We will require payment in full before the class commences.

For classes delivered directly by MC Yoga online or in person or in private settings we accept payment via the website by credit or debit card.

 

For classes delivered by MC Yoga payment is to be made directly to the studio in question.

We are not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or Credit Card companies.

All transactions online will be processed in EURO (€). We cannot accept any other currency for payment.

 

Bookings


We will require payment in full in order to book your place in any class.

All courses are run on a continuous basis and you can join at any time once you pay for your course.

To reserve a place, go to the ‘Schedule & Booking’ page and complete the relevant booking form and payment form.  


Some class sizes are limited so please book early to avoid disappointment.

 

If a class or a class pass is purchased at one of the studios Michelle teaches in then any changes, cancellations etc must be made with the studio directly, and not with Michelle or MC Yoga. Also please note the terms and conditions at the studios Michelle where teaches in will be different to the terms & conditions on the MC Yoga page. Whomever you purchase your class with is with whom the conditions apply.

Cancellation Policy (for Bookings)

​

All classes -workshops must be cancelled 24 hours before class takes place.  Any late cancellations or no show or studio and online classes will result in a loss of studio credit with no refund issued.  This is to ensure that we can offer your space to another student if there is a waiting list.


Any late cancellations or no shows for classes will reduce the number of allowed classes by number missed. This is to ensure that we can offer your spot to another student if there is a waiting list.

Return / Refund Policy (for Payments)
 

Refunds for class bookings will not be given – it is your responsibility to ensure that you have selected the correct class, cost, booking and start time before arriving at the studio/online class. 
 

All class types are clearly described on our website.


Prices for all classes are listed in the ‘Schedule & Booking’ section of the website.


Class start and end times are listed on the ‘Schedule & Booking’ page.


We reserve the right to cancel any classes that are listed on our ‘Schedule & Booking’ page. In the rare event that this should happen, we will notify you as soon as possible and we will exercise one of the following at your request:​

  • Allow you to book into a different class or different time
     

  • Refund you the cost of the class (in the event of a single drop-in booking)
     

If you are not satisfied with any aspect of the class, please bring this to our attention immediately by phone or by email (contact details are listed at the bottom of the page). We will endeavour to investigate your issue as soon as possible. All cases will be looked at on an individual basis.


If a refund is required, it can only be made to the same method of payment as your original payment, and refunds will be made less booking charges.

 

Registration for Classes
 

All classes, courses or workshops purchased from us must be preceded by the applicant acknowledging, by way of completing a Booking Form, that he/she has no physical limitations preventing him/her from participation.


You must ensure that the details provided by you on registration or at any time are correct and complete.


Specifically, as noted on the Booking Form, you acknowledge that, considering your own capabilities and limitations, it is not necessary for you to undertake the practices, exercises and training suggested by the class teacher. You undertake all practices, exercises and training voluntarily. In part consideration of being permitted to participate in the classes or workshops, you assume full responsibility for all or any risk, injuries or dangers, howsoever arising, which might occur as a result of participating in the said classes or workshops. In further part consideration of being permitted to participate in classes or workshops, you knowingly, voluntarily and expressly waive any claim against MC Yoga for injury or damage that you may suffer as a result of participating in the said classes or workshops. You covenant not to sue us for any injury or damage caused for any reasons whatsoever.


The applicant also agrees to abide by the rules and regulations of the studio and acknowledges that these rules and regulations may change from time to time.


All applicants must be over 18yrs of age in order to book a class with MC Yoga. Should an applicant be under 18yrs of age, please contact Michelle privately.


Furthermore, all applicants release MC Yoga, its owners, directors, managers and all employees & contractors of all liability regarding: 1) any injury to self or child 2) any loss or damage to personal property.


If purchasing packages that require payments to be made in instalments, the applicant agrees to approve such instalments be made by credit card on the dates as predetermined in the services contract.
